Terms & Conditions

Please read our terms and conditions carefully before purchasing any of our products and services to ensure you understand how we operate and any restrictions or commitments.

1. Agreement

a) The terms and conditions herein applies to all goods and services supplied by Lancasters - Lancaster Studio, 18 Forster Road , BR3 4LJ.
b) We may at times convenient to us change these terms and conditions without prior notification. Please ensure you read these prior to every order.
c) A contract only exists between you, the customer and us, the supplier after we have provided a written quotation or you have agreed the price of sale of goods either by committing to an online transaction or by written acceptance. Failure to do so negates a supply of goods or services at any time.
d) Upon completion of an order by any of the methods described in 1c you will be sent an email confirming the services or products purchased along with an order number and final value to be paid.
e) Some purchases may require a deposit or payment in full prior to processing your order. If this is the case you will be notified in writing with your order details or during the order procedure.
f) You have the right to cancellation subject to section 2.

2. Cancellation

a) You have the right to cancel your order within 7 working days from the date and time of your order.
b) If your order is for web services or web design you may be liable to contribute payment to any work undertaken during this period.
c) You must notify us in writing within 7 working days of your cancellation by email, fax or letter specifiying the products and services you no longer require and your order number.
d) Lancasters are not responsible for undelivered email, faxes or mail and reserve the right to reject cancellation if not received within 7 working days.
e) If your cancellation is on or over 7 days from the date of purchase of material goods from us you are responsible for the cost and safe transit of goods back to us. Reasonable care must be taken by you, the customer to ensure that all goods are packaged correctly. You may be charged at the discretion of Lancasters for damaged goods returned.
f) Once you have notified us of your cancellation and goods and services have been returned to us we will credit or refund you the sum paid upon purchase minus any penalty for damaged or unrecovered goods or services. Any credit card surcharge will not be refunded.
g) We reserve the right to cancel, without prior notice, any services provided where that service becomes deprecated or superceded.

3. Price & Description Of Goods

a) All goods and services are subject to availability.
b) If at the time of your order, the product or service is unavailable or not in stock you will be notified as soon as possible and further actions will be agreed between Lancasters and you, the customer. If no agreement is met your order will be cancelled and you will be refunded any sum you have paid or debited,  minus any credit card surcharge.
c) In the event of a pricing or description error you will be notified as soon as possible and be given the option to choose an alternative option at the new price quoted, wait for that product or service to become availablr or cancel your order in full or part.
d) You may be required to pay a delivery or set-up charge for goods and services in addition to the listed price.
e) All work undertaken will be subject to the current rate of VAT.
f) Any advice, consultation, meetings and telephone support will be charged at the present standard hourly rate unless the advice is with regard to using one or more of our products, information about our products, or regarding a fault with your website or one of our products.
g) With reference to 3f, whereby a website does not have a maintenance contract in place as offered from January 2012, the resolution of faults will be charged at our standard rate.

4. Delivery

a) Your goods and services will be delivered or produced for the address and details given at the time of order.
b) In the event that you provide incorrect details and instructions for the delivery of goods where reasonable you will still be charged for the goods and service in your original order. Any subsequent change of these details will result in processing a new order and subsequent changes will apply.
c) If you do not reasonably take delivery of the goods or services supplied you may be charged for the storage or subsequent redelivery of these goods or services including insurance or other related costs.
d) Your order will be delivered as soon as possible after your order has been accepted or when it is convenient to you.
e) If you choose a non-recorded method of delivery we are not responsible for the loss of goods or services through a third party delivery or postal service. Please ensure you either choose a method of delivery best matched to your goods and services and select insurance where possible.
f) Please sign for any parcel 'unchecked' for the purposes of cancellation and returns. Failure to do so may result in the refusal of any warranty claim.

5. Payment

a) Goods and services can be paid by any of the methods shown on our website or by any method shown in our quotations.
b) Payment must be made at the time of purchase unless another expressed written agreement is given.
c) If for any reason payment by you is null or void due to unforeseen circumstances, any amounts due will still be your responsibility and Lancasters will persue all reasonable claims against you for unpaid amounts and interest and charges in connection with making these claims will be due.
d) Invoice terms are strictly 14 days from the date of invoice for credit account holders. Interest maybe charged for late payment.
e) Where a payment has not been received we reserve the right to cancel services which may result in the loss of valuable items, service, or custom. It is the customers responsibility to ensure that payment is supplied within the payment terms.
f) We may remove our 14 day credit period at any time.
g) Late payments will automatically reduce or remove any credit facility or post work invoice terms. We may refuse to undertake work or supply services to customers who are unable to meet our payment terms.
h) Non-credit and new customers are expected to pay for goods or services on finalising a contract or order. Until payment is received there is no obligation for Lancasters to undertake any work.

6. Guarantee

a) If material goods supplied do not arrive in perfect condition and/or are damaged preventing correct or full use you should notify us within 10 days.
c) If goods or services develop a fault you must notify us immediately and return the product to us for testing. We will where possible repair the product and return or issue a new or replacement component where possible. Where the goods are electronic we will investigate the fault and repair (subject to subscription terms (3g).

7. Liability Limitation

a) Lancasters do not accept any liability for loss or damage as a result of goods and services supplied to you, the customer. All products and services are purchased as described and for the purpose therein.
b) When possible Lancasters will provide secure anti-fraud payment and accept no liability for the theft of your personal information or credit card out of our reasonable control.
c) Liability is not limited for death by negligence by Lancasters within the terms and conditions.
d) Lancasters provides a wide range of products and services. Our core service is bespoke website design. It cannot at any time be expected that SEO, Marketing, Advertising, Media, or any other non-design based component is included within this service unless requested and contracted by the purchaser as part of a contract or via one of our subscription services.
e) Where the product is a website, we do not provide a full SEO service as part of new website design unless contracted.

8. Liability Limitation

a) Lancasters will take all reasonable precautions to keep the details of your order, payment details and personal information secure and restricted to key personnel. Your personal information will not be given to any third party prior to your given written agreement or consent.

9. Product Images and Templates

a) Product and Service Images and Templates may differ from the actual ones displayed in published material or on our website and will be subject to change without our prior notification.
b) Where possible you will be notified that the image or service will be different from usually displayed.

10. Non Payment

a) As a result of non-payment or a failure to make an agreed payment, Lancasters may suspend a service or recover products purchased. You may be liable for court costs and legal expenses in the event of dispute following non-payment for a sustained period.
b) Any dispute arising from the contract existing between you, the customer and Lancasters, the supplier, will be dealt with under United Kingdom Law and Statutes and courts unless otherwise agreed with Lancasters prior to legal action.
